Reporting requirements: DMIRS and ACNC

All incorporated associations in WA are overseen by the Department of Mines, Industry Regulation and Safety (DMIRS – Consumer Protection). Incorporated associations can manage their incorporation and reporting online through the AssociationsOnline portal. As most of Linkwest's member Centres are incorporated associations, most of you will be familiar with the portal - which you will have used to, for example, lodge your updated constitution.

Every year, associations are required to submit an information statement to DMIRS – Consumer Protection (through AssociationsOnline). This statement confirms the association is still active, eligible to be incorporated and has held its Annual General Meeting (AGM).

Some incorporated associations - including some of Linkwest's member Centres - are also registered with the Australian Charities and Not-for-profits Commission (ACNC). Previously, you would have had to report both to both DMIRS – Consumer Protection and the ACNC.

However, DMIRS – Consumer Protection and the ACNC entered into a streamlined reporting arrangement from the 30 June 2020 reporting period. This means:

Associations that are also charities registered with the ACNC no longer need to report directly to DMIRS – Consumer Protection and only have to report to the ACNC.

In summary:

If your Centre IS NOT registered with the Australian Charities and Not-for-profits Commission (ACNC) you will need to submit your Annual Information Statement and financials to the Department of Mines, Industry Regulations and Safety via your AssociationsOnline account.

AssociationsOnline Portal 

If your Centre IS registered with the ACNC, you will need to submit your Annual Information Statement and financials onto the ACNC portal. You will also need to update responsible persons on the ACNC. To do this you will need to have asked the new board members to complete an ACNC responsible persons form, which includes full home address details.
